Terms of Service

Effective date: October 23, 2026

These Terms of Service (“Terms”) apply to your use of the Appalachian Wash Pros website and, where applicable, requests for and purchases of our exterior cleaning services. Please read them carefully. By using the website, you agree to the website-related provisions below. A service appointment is subject to the separate quote, work authorization, or service agreement you accept for that job, as well as the applicable provisions of these Terms.

1. Who We Are and Where We Serve

“Appalachian Wash Pros,” “we,” “us,” and “our” refer to Appalachian Wash Pros LLC, a family-owned exterior cleaning company based in Hendersonville, North Carolina. We can be reached at:

• Phone: 828-708-0469

• Email: chad@appwashpros.com

• Website: https://www.appwashpros.com

We serve residential and commercial customers in Hendersonville, Asheville, Brevard, Mills River, Fletcher, Lake Toxaway, Woodfin, Swannanoa, Laurel Park, Royal Pines, Biltmore Forest, Candler, Arden, Fairview, and Weaverville, North Carolina, as well as surrounding areas where we agree to provide service.

Our services include residential and commercial pressure washing of driveways, walkways, and other hard surfaces; soft washing of siding and roofs using biodegradable detergents; window and screen cleaning; and solar panel and skylight cleaning. We offer free, no-obligation estimates. Our team has over 20 years of hands-on experience and is licensed and insured. Our gentle soft-wash approach, efficient service, and 100% satisfaction guarantee are subject to the applicable quote and the terms in Section 12.

2. Eligibility and Permission to Use the Website

You may use this website only if you can legally agree to these Terms. If you use it on behalf of a business or another person, you represent that you are authorized to accept these Terms on their behalf.

We give you a limited, revocable, non-exclusive, non-transferable license to access and use the website for lawful personal, or business purposes related to learning about our services, requesting information, or contacting us. This license does not transfer ownership of the website or its content to you.

3. Acceptable Use

You agree not to:

• Use the website in violation of any law, regulation, or third-party right.

• Attempt to interfere with the website’s security, operation, or availability.

• Introduce malware, harmful code, or other destructive material.

• Access or attempt to access accounts, systems, or data without authorization.

• Misrepresent your identity, submit false information, or impersonate another person.

• Use automated means to scrape, copy, or collect website content or data without our written permission.

• Use the website or its content to advertise or promote an unrelated product or service without our written permission.

We may restrict or suspend access to the website if we reasonably believe that you have violated these Terms or misused the website.

4. Website Content and Intellectual Property

The website and its content—including text, design, photographs, videos, graphics, logo, and other materials—are owned by or licensed to Appalachian Wash Pros LLC and are protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved. You may not reproduce, modify, distribute, publicly display, sell, or create derivative works from our website content without our prior written permission, except as permitted by law. You may share links to publicly accessible pages of the website, provided you do not suggest that we endorse you or your organization.

5. Estimates, Quote Requests, and Service Agreements

Requests submitted through the website, by phone, by email, or through another contact method are requests for information or an estimate. A request, appointment inquiry, or estimate request is not itself a binding service contract and does not guarantee that we can perform the requested work.

We will provide a written quote when appropriate. A quote is valid for one year from its issue date unless the quote states a different validity period. It applies only to the work, property, conditions, and scope described in it. A service contract is formed only when you accept the quote or other written service terms and we confirm or otherwise authorize the work in writing.

The quote will identify the agreed scope and price, including applicable taxes or other charges where required. If we discover conditions that materially affect the scope, time, materials, or cost—such as heavy oxidation, hidden damage, severely soiled surfaces, or additional square footage—we will explain the change and obtain your approval before performing additional chargeable work. We will not treat your silence as approval for a price increase.

6. Scheduling, Appointment Windows, and Weather

Appointments are scheduled subject to availability. Any date or arrival time we provide is an estimate unless we expressly confirm a guaranteed time in writing. An arrival window may be affected by traffic, the length of earlier jobs, equipment issues, or other operating conditions.

We generally proceed in light rain, but we may delay or reschedule exterior cleaning due to severe weather, freezing temperatures, or other unsafe conditions that could affect safety or the quality of the work. We may also reschedule if we reasonably determine that conditions at the property make the work unsafe or impractical. We will make reasonable efforts to notify you and arrange another time. Weather-related rescheduling does not by itself create a right to compensation, and rain alone does not qualify a completed cleaning for a free repeat service.

7. Your Responsibilities Before and During Service

Before the appointment, you agree to:

• Provide safe and reasonable access to the areas to be serviced and ensure someone authorized can answer questions or approve any agreed changes.

• Make an available, functioning outdoor water spigot accessible, unless we have agreed in writing to another water arrangement.

• Move vehicles and personal property away from work areas.

• Close windows and doors and, where appropriate, notify occupants to keep them closed during service.

• Provide safe access to interior windows where interior window cleaning is part of the agreed scope, and move furniture that would obstruct the work areas before our arrival. Any assistance you need moving larger items should be arranged with us beforehand.

• Remove or protect fragile, valuable, or easily damaged items near the work area before our arrival.

• Secure pets and keep children and others clear of active work areas.

• Tell us about known damage, loose siding, failing seals, water intrusion, previous repairs, prior damage, sensitive plants, or other conditions that could affect the work.

• Obtain any required permission for work on property you do not own or control.

Please notify us before work begins if any of these arrangements cannot be made. If we cannot safely access the work area or perform the agreed work because of an issue within your control, we may pause the job, reschedule it, or charge a disclosed no-access or trip fee as described in Section 10.

8. Service Methods, Limitations, and Results

We select cleaning methods based on the service requested and the observable condition of the property. Soft washing uses low-pressure application and biodegradable detergents intended to clean exterior surfaces more gently than high-pressure washing. Pressure washing is used for suitable hard surfaces. Not every surface is suitable for every method.

Cleaning results depend on the material, its age and condition, previous treatments, the type and age of staining, weather, and other factors. Some staining or discoloration may not fully come out. Examples include oxidation, rust stains, efflorescence, paint failure, oxidized aluminum, wood discoloration, and stains that have penetrated or permanently altered a surface. Cleaning may reveal pre-existing fading, wear, defects, repairs, or discoloration that was less visible before the work.

We do not guarantee that cleaning will prevent future staining, algae, mildew, or other growth, or that results will last for a particular period unless we expressly agree in writing. We will not knowingly use a method that we reasonably believe is unsafe for a surface, but some surfaces may not be cleanable without risk. If we determine that the requested work presents an unreasonable risk of damage, we may decline or stop that work.

8.1 Window and Screen Cleaning

Standard window cleaning includes the glass and a light wipe of accessible sills and frames. Screen cleaning is included only when specified in the quote.

8.2 Gutter Cleaning

Where quoted, gutter cleaning includes removal of debris and flushing of downspouts. Exterior gutter brightening is a separate service and is not included unless specifically quoted.

8.3 Excluded Work

The following are excluded from standard services unless specifically quoted in a written quote or service agreement: deep-track detailing; removal of post-construction debris such as paint, silicone, and adhesive; hardwater or oxidation removal; and staining between the panes of insulated glass.

9. Property Condition and Pre-Existing Damage

You are responsible for disclosing known defects or vulnerabilities that could affect the service, including failing window or door seals, loose or damaged siding, deteriorated paint, cracked surfaces, previous repairs, or water intrusion. We may photograph or document visible conditions before or during the work.

You understand that cleaning can expose pre-existing damage or aggravate an existing defect, particularly where a surface, seal, coating, or building component is already compromised. We are not responsible for damage caused solely by a pre-existing condition that was not caused or worsened by our work. Nothing in these Terms waives responsibility for damage to the extent it is caused by our negligence, willful misconduct, or other conduct for which liability cannot legally be waived.

10. Prices, Payment, Cancellations, and No-Access Situations

10.1 Payment

Unless the written quote or service agreement says otherwise, payment is due upon completion of the service. We accept cash, check, Venmo, Zelle, credit cards, and ACH. Where a commercial proposal calls for a deposit, the deposit requirement and amount will be specified in that individual proposal. Any deposit, cancellation charge, or other fee is subject to applicable law and the terms disclosed to you before you agree to the work. Please contact us promptly and in good faith with any questions about an invoice.

10.2 Customer Cancellation or Rescheduling

We may charge cancellation, rescheduling, or no-access fees when an appointment is cancelled, rescheduled, or cannot proceed as scheduled. Any applicable fee and notice requirement will be disclosed to you before you accept the appointment, and no fee will be charged where prohibited by law. Any such fee is intended to reflect reasonable costs or losses, not to impose a penalty.

Certain transactions may carry cancellation rights or notice requirements under applicable law. Nothing in these Terms limits a cancellation right that the law provides.

10.3 No Access

If our crew cannot access the property or work area at the agreed time because of an issue within your control, we may attempt to contact you and may wait a reasonable period. If the work cannot proceed, we may reschedule and charge a no-access or trip fee, provided the fee was disclosed before you accepted the appointment and is permitted by law.

11. Customer Concerns and Damage Claims

If you believe our work caused damage or did not match the agreed scope, contact us as soon as reasonably possible at 828-708-0469 or chad@appwashpros.com. Please report a concern promptly after you discover it, explain what happened, identify the affected area, and provide photographs where practical or other information that may help us assess it. Reporting promptly helps us investigate while conditions can still be reviewed, and nothing in this section limits rights you may have under applicable law.

Please give us a reasonable opportunity to inspect the area and, where appropriate, correct the issue. Do not repair, discard, or materially alter the affected area before we can inspect it, unless prompt action is reasonably needed to prevent further damage or protect health or safety. This request does not require you to delay emergency mitigation.

12. 100% Satisfaction Guarantee

We stand behind our cleaning within the agreed scope of the written quote. If an area was missed or inadequately cleaned, contact us at 828-708-0469 or chad@appwashpros.com and describe the concern. We will inspect the affected area and, where a qualifying concern is confirmed, re-clean it at no additional charge.

If corrective cleaning does not resolve a qualifying concern, we will work with you on an appropriate resolution, which may include a credit or partial refund for the affected service. The guarantee does not promise removal of permanent stains or conditions identified in Section 8, correction of pre-existing defects, or work outside the agreed scope, and it does not apply to a concern caused by a pre-existing condition, subsequent events, or work by someone else. Claims that our work caused damage to property are handled under Section 11. The guarantee does not limit rights that cannot legally be waived.

13. Disclaimer of Warranties and Limitation of Liability

To the maximum extent permitted by law, the website and its content are provided “as is” and “as available.” We do not guarantee that the website will be uninterrupted, error-free, or available at all times. Nothing in these Terms excludes a warranty or right that applicable law does not permit us to exclude.

For services, our written quote, service agreement, and the guarantee in Section 12 describe the work and remedies we offer. Except for those express commitments and any rights that cannot legally be waived, we make no additional warranty that a surface is free of defects or that a particular cleaning result will be achieved.

[Liability cap pending legal and insurance review.] To the maximum extent permitted by law, we are not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits or loss of use. These limits do not apply to liability that cannot legally be limited, including liability for fraud or willful misconduct, or to the extent a court determines that the limitation is unenforceable.

14. Indemnification

You agree to be responsible for claims, losses, and reasonable expenses resulting from your violation of these Terms, your unlawful use of the website, or your failure to obtain required permission to authorize work at a property. This provision does not require you to indemnify us for claims to the extent they result from our negligence, willful misconduct, or other conduct for which indemnification cannot legally be required.

15. Third-Party Links

The website may link to websites or services operated by third parties. We provide those links for convenience only and do not control or endorse third-party content, products, services, or privacy practices. Your use of a third-party website is governed by its own terms and policies.

16. Reviews and Other User Submissions

If you submit a review, photograph, testimonial, or other content to us, you retain any ownership rights you have in that content. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share the content in connection with our business and marketing, including on our website and social media. You represent that you have the rights and permissions needed to submit the content and grant this license.

We will not knowingly use your submission to falsely suggest that you endorse a statement or service you did not endorse. If a submission includes a person who can be identified, you are responsible for obtaining that person’s permission where required by law. We may remove or decline to use submitted content.

17. Privacy, Electronic Communications, and Text Messages

Our Privacy Policy explains how we handle information collected through the website. It is available at https://www.appwashpros.com/privacy and is incorporated by reference for that purpose.

By contacting us or submitting a request, you agree that we may respond using the contact information you provide, including by phone, email, or text message, as appropriate to your inquiry or service. Consent to receive marketing calls or texts is not a condition of purchasing services. We will send marketing communications only where permitted and, when required, after obtaining your consent.

SMS Terms of Service

These SMS terms apply to text-message programs associated with our online booking, lead forms, and marketing SMS opt-in forms. Online booking allows customers to book and pay online through Google, our website, or a direct booking link. Lead forms allow customers to submit their contact information and inquiry through a form on our website. Marketing SMS opt-in forms allow customers to provide their phone number and expressly opt in to receive marketing and promotional text messages from Appalachian Wash Pros. Submitting a booking or lead form does not by itself constitute consent to receive marketing text messages.

You may stop receiving marketing text messages at any time by replying STOP to the number or short code from which you received the messages. We will send a confirmation message after processing your opt-out, and you will not receive further marketing texts unless you opt in again. To rejoin, sign up again through one of our opt-in methods.

For help with the messaging program, reply HELP or contact us at 828-708-0469 or chad@appwash-

pros.com.

Wireless carriers are not liable for delayed or undelivered messages. Message and data rates may apply to messages sent to you by us and to us by you. Message frequency may vary. Contact your wireless provider with questions about your text or data plan.

You may also opt out of marketing texts using any other method required by applicable law. We may still send non-marketing messages reasonably related to an active inquiry, appointment, or transaction, subject to applicable law.

You agree that we may provide notices and other communications electronically where permitted by law. You may request paper communications by contacting us, although some service records or confirmations may be available electronically.

18. Force Majeure

Neither party is responsible for a delay or failure to perform caused by circumstances beyond its reasonable control, such as severe weather, natural disasters, government action, labor disruptions, utility outages, or emergencies. The affected party will make reasonable efforts to give notice and resume performance when practical. This section does not excuse payment for services already completed.

19. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Any legal action arising from these Terms or our services must be brought in a state court located in Henderson County, North Carolina, or, where federal jurisdiction exists, in a federal court with jurisdiction over Henderson County. Each party consents to the personal jurisdiction of those courts, subject to any rights that cannot legally be waived.

20. General Terms

If any part of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect, and the invalid provision will be modified only to the extent necessary to make it enforceable if the law allows.

These Terms, together with the Privacy Policy and any quote, work authorization, or service agreement that applies to a particular job, are the entire agreement concerning their subject matter. If a job-specific written agreement conflicts with these Terms, the job-specific agreement controls for that job to the extent of the conflict.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, or transfer of our business, to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms do not create an agency, partnership, joint venture, employment, or fiduciary relationship between you and us.

21. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date above. Changes apply from the date they are posted unless the revised Terms say otherwise. A change will not alter a service agreement already accepted unless you and we agree to the change or applicable law permits it.
